Genealogical note: The following is a record of a David Lockheart who lived in Alleghany County, Virginia and who mentioned "the Children and legal Heirs of my son David Lockheart now deceased" in a 9 Oct 1830 document where David, Sr. divided "my landed estate between my surviving Children." We know from a court document that a younger David Lockheart had married Tomsey Jackson in 1812 in Madison County, Virginia, had bought land in Culpeper County, Virginia in 1828, and that the T. Lockert family in the 1830 census for Culpeper County, Virginia had no male over age 19. Thus, it's possible that the younger David Lockheart who died between 1828 and 1830 was the son mentioned by the elder David Lockheart.
David Lockheart married Rachel Lewis on 21 August 1789 in Frederick, Virginia.
The David Lockheart family is enumerated in the 1810 U. S. census for Shenandoah County, Virginia (roll 71, page 10) as David Lockheart, one male age 10-15 [John, 15], one male 18-25 [James L., b. 23 Dec 1789], one male 45 or older (David, born before 1765), one female under 10 [Sarah Ann, b. 18 Mar 1806, and Elizabeth, b. 21 Nov 1801], two females 10-15 [?], and one female 45 and older [Rachel Lewis?], born before 1765.
The David Lockheart family is enumerated in the 1820 U. S. census for Bath County, Virginia (roll M33_129, page 74) as David Lockheart, one male 16-26 [John, 25], one male 45 and older (David), one female under 10 [?], one female 10-15 [Sarah Ann, b. 18 Mar 1806], one female 16-26 [Elizabeth, b. 21 Nov 1801] and one female 45 and older (Rachel Lewis?). James Kendle and Able Jackson, both sons-in-law of David Lockheart.
In 1822, Alleghany County was formed from a part of Bath County.
Surveyor Joseph Dawson filed a court document on 04 Oct 1830 (Alleghany County Circuit Court Deed Book 2, page 355), attesting: "Surveyed for David Lockheart, the land above represented by Lot No. 1 on the above Plat; said Lot no. 1 contains 278 acres, in Alleghany County, on Ogle's Creek, a Branch of Dunlaps Creek, which is a Branch of Jacksons River, being the land on which James L. Lockheart and Francis Edgar now reside; 218 Acres thereof being Part of the land said David L. Lockheart purchased from Jacob Pence. 15 acres thereof, being part of a Tract of 57 Acres Patented to said David Lockheart, on the 31st Day of October 1826; 3 Acres thereof being Part of a Tract of 21 Acres patented to said D. Lockheart, on the 26th Day of August, 1826; and 42 Acres granted to said David Lockheart, on the 20th Day of June, 1827. . ."
Surveyor Joseph Dawson filed a similar court document on 04 Oct 1830 (page 356) attesting to the fact that David Lockheart had purchased 189 acres from Jacob Pence, adjoining lot number 1, and another document (pages 357-8) attesting to the fact that he had purchased the land from Jacob Pence in 1828, "being part of a survey of 6 Acres made for John Callaghan, on the 31st December 1825. . ."
The David Lockhart family is enumerated in the 1830 U. S. census for Alleghany County, Virginia (roll 189, page 121) as David Lockhard, age 60-70, placing his birth in the 1760s, and a female also age 60-70, placing her birth also in the 1760s. The James Lockhart family was also enumerated in Allegheny County, as was the James Kindell family. James Kindle married Mary A. Lockheart on 22 Jan 1813 in Shenandoah County, Virginia.
On 09 Oct 1830, David Lockheart signed a document in Alleghany County court attesting to the fact "that having determined to divide my landed Estate, between my surviving Children, as equally as may be, have caused my lands in the County of Alleghany, to be divided by Joseph Dawson Surveyor of said County, agreeably to the foregoing connected plat; and certificates into five equal parts to wit: ~" The first plat contained 278 acres, which consisted of 2/5 of all his lands consisting of two shares, one for his son James L. Lockheart and the other for his daughter Sarah Edgar, wife of Francis Edgar. The second plat contained 310 acres, which consisted of another 2/5 of all his lands, to be given to his son John Lockheart and daughter Elizabeth Jackson, wife of Abel Jackson. The third plat contained 150 acres, which consisted of 1/5 of his land, to be given to his daughter Polly Kendle, wife of James Kendle. He charged each "five dollars of lawful money of Virginia."
David Lockheart wrote that "I reserve to my self, and my wife, during either or both of our natural Lives, the Privilege of living on any part of the land which I or my wife, as both of us may think proper, and use as much of said land, as we or either of us may think necessary. . . If through disability or misfortune of my kind, we should ever be reduced to want, so as to require the Profits of the Rents of the whole Lands to support us or either of us comfortable, I reserve the right and Privilege of doing so. . . And I hereby obleige my self, my Heirs, re: to pay or give to the Children and legal Heirs of my son David Lockheart now deceased, such sum of money as will, together with the money which my said son borrowed from me in his lifetime, make five Hundred Dollars, to be paid out of my Estate, provided I should not be disposed to pay it during my Life time; which is to be to them, in lieu of an equal Interest in my Lands, herein before disposed of." The deed was recorded on 16 Aug 1833.
David Lockhart is enumerated in the 1840 U. S. census for Alleghany County, Virginia (roll 551, page 101) as living alone, age 70-80, age consistent with earlier censuses. James Lockhart and James Kindell were neighbors.
