    Court
    1675
He was involved in a court case in 1675. William Cogswell faced a lawsuit from his nephew, John Cogswell. John, the son of the deceased John Cogswell (the 2nd), demanded an accounting of his late father's estate. William had been released from this responsibility by the court in 1664 and refused to comply with the new demand. However, a search by the court clerk failed to locate the original account records, leaving William in a difficult legal position. The court refused to grant any extensions and issued its final judgment of £54 18s. od. to the plaintiff, i.e. John (the 3rd), with costs. William appealed this decision to the next court, which confirmed the sentence, and bound the defendant to the sum of £300 to give a just and full account. The account was delivered to John, who caimed that it was false, and rejected. Suit against William was entered at Salem in January 1676, which brought judgment of £300 against William; from which a ppeal was made to the court in Boston. This court reversed the judgment in September 1676 and brought court costs against John Cogswell inthe amount of £13 4s. John did not pay these charges, but in October 1676 petitioned the General Court. The court ordered him to liberty, and granted him a hearing, to which William was summoned. The whole case was heard over again on 29 May 1677. The conclusion was that the plaintiff had to pay the judgment rendered of £13 4s, ending the historic case of Cogswell vs. Cogswell.
